NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
The Nature’s Way® Content Submission Sweepstakes (“Sweepstakes”) is sponsored by Nature’s Way Bird Products, 9054 E. Washington St., Chagrin Falls, OH 44023 (“Sponsor”). This Sweepstakes shall be subject to these Official Rules, and by entering, all participants agree to and are bound by the terms and conditions contained herein and by related decisions of Sponsor which are final and binding.
Eligibility: This Sweepstakes is FREE to enter and open to all legal residents of the United States and the District of Columbia who have reached the age of majority in their jurisdiction of residence at the time of entry (“you” and/or “Entrant”). Employees of Nature’s Way Bird Products, and its respective parent companies, subsidiaries, affiliates, sales representatives, dealers, distributors, licensees or agents, advertising and promotional agencies, and all such employee’s immediate family members and those living in the same household of each such employee, are not eligible to enter or win. Void outside of the United States and the District of Columbia, and where prohibited or restricted by law. All federal, state and local laws and regulations apply.
Entry Period: The Entry Period for this Sweepstakes begins on 7/1/2024 at 12:01AM (ET) and ends on 7/31/2024 at 11:59PM (ET) (“Entry Period”). Limit one entry per person.
How to Enter: During the Promotion Period, Entrants must:
Visit the Sponsor’s Dropbox file request link at https://bit.ly/4eqEU8e (the "Sweepstakes Site"). Follow the online instructions to submit qualifying images or videos (“Submissions”) by uploading them at the Sweepstakes Site. Entrants may gain more Entries by uploading multiple Submissions. Ensure that the Submissions follow the Sponsor’s requirements to be eligible as a Sweepstakes Entry.
Requirements:
- Entrant must input their valid email address in both of the required “Name” and “Email address” fields upon uploading their Submission(s). The Sweepstakes Winner will be contacted using the information input in the “Name” field. (The “email address” field information is not shared with the Sponsor by Dropbox.)
- There must be a Nature's Way product in the Submission.
- There must be at least one wild bird in the Submission.
- Each Submission must be different enough to be distinguished as separate Submissions (ie. different bird species, different angles, different feeders). Variations of the same Submission will not count as multiple Entries. Sponsor retains the right to deem what are distinguishingly different Submissions.
Sponsor will not advise an Entrant of an incomplete or otherwise non-compliant Entry. Entries made by any individual or any entity other than Entrant, including but not limited to commercial sweepstakes subscription notification and/or entering services, will be declared invalid and disqualified for this Sweepstakes. Use of automated entry systems and tampering with the entry process or the operation of the Sweepstakes is prohibited and any Entries deemed by Sponsor, in its sole discretion, to have been submitted in this manner will be void. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an Entrant, the Authorized Account Holder of the email address used to enter will be deemed to be the Entrant. “Authorized Account Holder” is defined as the person who is assigned to an email address by an internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
SPONSOR NOT RESPONSIBLE FOR DROPBOX COMPLICATIONS: Sponsor is not responsible for any changes or unavailability of Dropbox that may interfere with the Sweepstakes, including any limitations, restrictions, or conditions, at Sponsor’s sole discretion, on Sponsor’s ability to use Dropbox for the Sweepstakes as set forth in these Official Rules) or ability of Entrants to timely enter, receive notices or communicate with Sponsor via Dropbox, in which case, Sponsor, at its sole discretion, may terminate or modify the Sweepstakes.
By entering the Sweepstakes, Entrant agrees to abide by all applicable Dropbox rules and policies available at their respective sites.
Prize: No Prize substitutions will be made by the request of a Winner unless Sponsor, in its sole discretion, determines to do so. Sponsor reserves the right to substitute a Prize in whole or in part with another Prize of comparable or greater value for any reason in Sponsor’s sole discretion. A Prize must be accepted as awarded. Under no circumstances will more than one (1) total Prize be awarded. Winner will be awarded the following prize:

Total Estimated Retail Value of the Prize is valued at up to: $143.95
Winner Selection: Sponsor will randomly select one (1) winner from all eligible Entries at the conclusion of the Entry Period from all eligible Entries. If you are selected as a winner, you will be notified by the email submitted in the “Name” field of the Dropbox Submission. If you do not respond to the notification of your selection as a winner within three (3) days to claim your prize, an alternate winner may be selected to receive the prize at Sponsor’s sole discretion. Contacted winners must respond by email with the following information: 1) first and last name, 2) street address, 3) telephone number, and 4) email address.
Odds: Odds of winning depend on the total number of eligible Entries received during the Entry Period.
Disputes: Sponsor’s decisions are and shall be final in all matters relating to this Sweepstakes. If a prize notification or a prize is returned as undeliverable for any reason, the prize may be awarded to an alternate winner, at Sponsor’s sole discretion. Prize is not transferable, assignable or redeemable for cash, and winner may not elect to substitute one prize for another. If necessary, a prize of equal or greater value may be awarded at Sponsor’s sole discretion.
Entries that are lost, late, illegible, incomplete, misdirected or incompletely received for any reason, will not be eligible. Sponsor is not responsible for any incorrect, mistranscribed, misdirected or undeliverable Entries, incorrect announcements of any kind, or for any technical or logistical mishaps or difficulties that in any way affect the outcome of this Sweepstakes or award of the prize. Sponsor reserves the right in its sole discretion to disqualify any Entrant and/or individual it finds to be tampering with the entry process or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision provided herein.
Sponsor reserves the right to modify, extend, suspend, or terminate this Sweepstakes if Sponsor determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein including without limitation, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure, insufficient number of eligible participants or technical failure.

General Release/Governing Law: By entering, all Entrants release and waive any claim they may have against Nature’s Way Bird Products and their respective employees, officers, directors, shareholders, affiliates, subsidiaries, parent and related companies, distributors, dealers and agencies and their respective successors and assigns for injuries, claims, damages or losses, costs or expenses of any kind resulting from acceptance of or possession of or arising out of use or misuse of a prize or parts thereof or from participation in this Sweepstakes. Upon entering this Sweepstakes, Entrants authorize the use of their contact information for notification of winnings and as described in the Nature’s Way Privacy Policy found at www.natureswaybirdproducts.com, including updates made from time to time. If at any time you do not wish to continue receiving information from Nature’s Way Bird Products or you would like to withdraw the personal information you have previously disclosed, please visit www.natureswaybirds.com and follow the procedures in the Privacy Policy. Winner’s name and image may be utilized by Nature’s Way Bird Products as it deems appropriate and all Entrants authorize the use of their name and content by Nature’s Way Bird Products accordingly. By participating in the Sweepstakes, Entrant automatically provides Sponsor with permission to use your image, video or other content. By providing your permission, you represent and warrant that you own the content and there are no other entities with ownership claims over it. You grant Nature's Way Bird Products a non-exclusive and non-revocable commercial right to reproduce the content in any form (including, but not limited to, video, internet posting, reproduction, display, email, publication, and distribution), either through our own services or services provided by third parties, throughout the world in any medium now known or later developed and without restriction or limitation. You agree that your content may be used by Nature's Way Bird Products either alone or in conjunction with sketches, cartoons, captions, films, art work, textural matter or other photographs. While Nature's Way Bird Products will make commercially reasonable efforts to give you credit for your content and provide a link back to your Dropbox account when applicable, you agree that such credit is not mandatory and your permission for us to use your content is not contingent upon such credit being given. You waive any right to inspect and/or approve the finished work incorporating the content or the advertising copy that may be used in connection therewith or the use of which said finished work may be applied. Further, you waive any claims to royalties with regards to your content or our finished work. Acceptance of any prize constitutes prize winner’s permission for Sponsor and/or Sponsor’s designees to use winner’s name and home city and state for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter devised, in perpetuity, without further compensation or authorization (except where prohibited by law), and releases Sponsor from all claims arising out of such use. Liability for any applicable federal, state or other taxes or fees will be the sole responsibility of the winner. This drawing is governed by the laws of the state of Ohio. The exclusive venue of any suit or cause of action arising directly or indirectly from this drawing shall be in the state of Ohio.
